Whereas by a certain Indenture of Settlement made previous to my marriage with my present wife Dorothy Hemingway late Dorothy Parker bearing on or about the fifth day of January One thousand Seven hundred and Ninety Six all my messuages Lands Tenements Hereditaments and Premises hereinafter particularly mentioned are made subject to and chargeable with the payment of Annuity or a yearly rent charge of twenty pounds unto my said wife or her Assigns for and during the term of her natural life and whereas although the whole of my Estates are Charged and Chargeable as aforesaid yet I am desirous and my Will and Mind is that the same shall be charged and payable out of the premises next hereinafter given and devised unto my Son in Law Solomon Hindle of Dewsbury aforesaid Liquor Merchant only that is to say I give and devise to the said Solomon Hindle all those my two freehold Messuages Dwelling Houses or Tenements with the Warehouses Woolchambers Stables Yards and all and singular other the Appurtenances thereto belonging situate and being at Dewsbury aforesaid and now in the several Tenures or Occupations of the said Solomon Hindle my Son James Hemingway and Richard Ward or their respective under tenants or Assigns to have and to hold all and every the same Messuages Hereditaments and premises with the Appurtenances to him the said Solomon Hindle his Heirs and Assigns for ever Subject Nevertheless to and charged and chargeable with the aforesaid Annuity or Yearly Rent Charge of twenty Pounds to my said wife Dorothy Hemingway for and during the term of her natural life and also subject of Nevertheless to and charged and chargeable with the Further Annuity Yearly Rent or Sum of Five Pounds hereinafter mentioned and devised to my said wife Dorothy Hemingway and I do hereby for the care and attention which my said wife Dorothy Hemmingway hath for and pays to me give devise and bequeath unto her and her Assigns for and during the term of her Natural life (over and above the said Annuity of twenty Pounds as reserved and made payable to her as aforesaid) One other Annuity or clear Yearly Rent or Sum of Five Pounds of lawful Money of Great Britain Free and clear of and from all taxes and deductions whatsoever the said Annuity to be Chargeable and Charged on and payable out of the Said Messuages Hereditaments and Premises hereinbefore given and devised to my said Son in Law Solomon Hindle and to be paid and payable by him the said Solomon Hindle on the days and times and in such manner and form as the said Annuity of twenty Pounds made payable on and I do hereby Charge and Subject the said Messuages Hereditaments and Premises to and with the Payment of the Annuity Yearly Rent or Sum of Five Pounds accordingly and I do invest my said Wife and her Assigns with such powers and Authorities (in case the said Annuity or yearly Rent or Sum of Five Pounds shall be behind or unpaid by the said space of twenty Days next over or after any of the days of Payment whereon the same should be paid being first lawfully demanded as are particularly expressed and declared in the said in part recited deed for the entering upon and making distress for the receiving thereof upon the said hereditaments and premises so devised to the said Solomon Hindle as fully and effectually to all intents and purposes as if the same had been so particularly declared and expressed in such deed and from and immediately after her decease subject to and Charged and Chargeable with the payment pf the sum of Four hundred Pounds of lawful Money af Great Britain hereinafter mentioned and bequeath to my Brother in Law John Haigh of Dewsbury aforesaid Maltster and my good friend Abraham Hemingway of the same place Corn Miller and I do hereby give and bequeath unto the said John Haigh and Abraham Hemingway their Executors and Administrators the Sum of Four hundred Pounds of lawful money of Great Britain to be paid to them by the said Solomon Hindle within six months after the decease of my said Wife upon trust that they the said John Haigh and Abraham Hemingway or the Survivor of them or the Executors or Administrators of such survivor shall and do immediately after they shall receive the said Sum of Four hundred Pounds pay thus and unto my son James my daughters Sarah Standish Hannah the wife of the said Solomon Hindle Elizabeth the wife of Timothy Parker of Dewsbury aforesaid Merchant Mary Hemmingway and Ellen Hemmingway if they shall be then living but if all of them shall not be living then to the Survivors of them and if more than One equally share and share alike Provided always and my Will and mind further is that in Consideration of the devise hereinbefore made to the said Solomon Hindle he the said Solomon Hindle shall and I trust and confide in his Integrity that he will pay this said Annuity in Yearly Rent Charge of twenty Pounds secured and made payable to my said Wife for life as aforesaid to go with the said Annuity or yearly Rent of five Pounds and also that he will and I do direct that he shall immediately after my Decease enter into a Bond or some other sufficient security (binding himself his heirs Executors and administrators in the Penal sum of One thousand pounds) to my son James Hemmingway and my daughter Sarah Standish my two devisees hereinafter named to keep them and their respective heirs Executors and Administrators Lands Tenements and Hereditaments harmless and indemnified of and from the Payment of the said Annuity or Yearly Rent Charge of twenty Pounds or any part thereof and that he will Faithfully and truly do the same accordingly also I give and devise unto my daughter the said Sarah Standish all that my Freehold Messuage dwellinghouse or Tenement with the Front Cellar Back Kitchen Yard and Garden thereto belonging and one half of the Pump as the same is now Occupied by the said Sarah Standish and myself and also the Stable now in the Occupation of William Webster and all and Singular the rights members Privileges and Appurtenances to the same premises in any Wise belonging or appertaining situate and being at Dewsbury aforesaid to have and to hold the same Tenements Hereditaments and premises with the Appurtenances to her the said Sarah Standish her Heirs and Assigns for ever subject to her aforesaid Annuity or Yearly Rent Charge of twenty Pounds to be kept harmless and indemnified by the said Solomon Hindle aforesaid Also I give and devise unto my son James Hemingway all that my Freehold Messuage Dwellinghouse or Tenement with the Workshops Stable Yard and Garden thereto belonging and One half of the Pump situate and being in Dewsbury aforesaid and now occupied by myself and also all those two Several Closes now enjoyed with the said last mentioned Messuage and Premises now only called or known by the name or names of the North Fields situate and being in Dewsbury aforesaid to have and to hold the same Messuage Tenements Closes Hereditaments and Premises with the Appurtenances to him the said James Hemingway his heirs and Assigns for ever Subject to the aforesaid Annuity or yearly Rent Charge of twenty Pounds but to be kept harmless and Indemnified by the said Solomon Hindle therefrom as aforesaid and also subject nevertheless to and Charged and Chargeable with the Payment of the Legacy or Sum of One thousand Pounds hereinafter mentioned and bequeathed to my son William Hemingway and I do hereby give and bequeath to my son William Hemingway now in the Kingdom or united States of America the Legacy or Sum of One thousand Pounds of Good and Lawful Money of Great Britain to be paid to him by my said son James within twelve Months after my decease to and for his own use and benefit and I do hereby Charge and Subject the said Messuage Closes Tenements Hereditaments and Premises last mentioned and devised to my said son James to and with the Payment of the same accordingly provided always that in case my said son William should be dead or should happen to die before the said Legacy or Sum of One thousand Pounds shall become due and payable then and in that case I do direct and my mind and Will is and I do give and bequeath the sum of Five hundred Pounds part of the said Legacy or Sum of One thousand Pounds unto and amongst all and every the child or children if more than One of my said son William who shall be then living share and share alike and the remaining Sum of Five hundred pounds residue of the said Legacy or Sum of One thousand Pounds unto my said Son James and my said Daughters Sarah Standish Hannah the wife of the said Solomon Hindle Elizabeth the wife of the said Timothy Parker and Ellen or to such of them as shall be then living share and share alike but in case my said Son William shall be dead or shall happen to die before the said Legacy or Sum of one thousand pounds shall become due and payable as aforesaid and without a Child or Children of his Body lawfully issuing him surviving then I do direct and my mind and Will is and I do bequeath the whole of the said Legacy or Sum of One thousand Pounds unto the whole to (?) such of my saod Daughters and Son James as shall be then living and if more than One equally share and shre alike Also I give and bequeath unto my said son James all and every my Engines Implements and utensils of and belonging to my trade and I do direct the same to be delivered to him immediately after my decease to and for his own use and benefit Also I give and bequeath unto my said Wife Dorothy Hemingway such Plate China and Furniture which belonged to her and which she brought with her at the time of our marriage together with the Bed and Beding which we now sleep on and the looking Glass half a Dozen Elm (?) Chairs and one oak Chest of Drawers which Stands in the Room we now sleep in and I so direct the same to be delivered to her immediately after my decease to and for her own use and benefit Also I five Devise and bequeath all my monies Securities for money in the Funds Book Debts Stock in Trade Household Furniture Plate Linen China Cows Horses Personal Estate and Effects whatsoever and whosesoever and of what nature and kind quality soever the same may be and Consist of and not hereinbefore disposed of unto the said John Haigh and Abraham Hemmingway their Executors and Administrators upon Trust to call in such monies as shall be out upon Interest and Collect in such debts as shall be due and owing to me at the time of my decease and also upon Trust to sell and dispose of my stock in Trade Household Furniture and other my Personal Estate which shall not be in money for the most money and the best price or prices they can reasonably get and obtain for the same and after such sale and collection the upon trust to pay out of such monies all my just Debts Funeral Expences and the Charges in Proving and Registering this my Will and after such payment and Satisfaction thereof then upon Trust to Pay and Discharge the Several and Respective Legacies hereinafter bequeathed that is to say I give and bequeath unto my said Son in Law Timothy Parker the Legacy or Sum of Five hundred pounds and I do direct the same to be paid to him by my said Trustees out of my said Personal Estate (so soon as the sum of Five hundred Pounds shall come into their hands and be by them received by virtue of the Trusts aforesaid) to and for his own use and benefit also I give and bequeath unto my said two daughters Mary and Ellen the Legacy or Sum of Six hundred Pounds apiece and I do direct the same to be paid to them respectively with lawful Interest from the time of my decease by my said Trustees out of my said Personal Estate so soon as the same shall come into the hands and be by them received by Virtue of the Trusts aforesaid to and for their own respective use and benefit and I do hereby Charge and Subject my said personal Estate with the payment of the said respective Legacies and Interest accordingly and as to the rest residue and remainder of the said monies and all other my personal Estate and Effects after Payment and Satisfaction as aforesaid I give and bequeath the same unto my said son James his Executors Administrators and Assigns for ever provided always and my Will is that my said Trustees hereinbefore named and the Survivor of them and their Executors and Administrators of such survivor shall and may at all times reimburse and indemnify themselves respectively out of the said Trust Premises all such Costs Charges Damages and expences as they or either of them shall or may at any time expend lay out and be put unto for or by reason or means of the trusts hereby in them reposed and that Neither of them shall be answerable for any loss which may happen to any of the said trust premises unless such loss happen through his or their Wilful Neglect or default nor one for the other or others of them nor for more monies than shall actually Come to each of their hands respectively but each and every of them for his and their Own Acts Deeds receipts Neglects and defaults Only nor for any loss which shall or may happen by Occasion of depositing any money in the hands keeping or Custody of any Public or Common Banker and Lastly I do hereby Nominate Constitute and Appoint the said John Haigh and Abraham Hemingway joint Trustees and Executors of this my last Will and Testament and I do hereby revoke and make Void all former and other Wills by me at any time heretofore made And I do declare these Presents to be and Contain my last Will and Testament while I the said Jonathan Hemingway the Testator have to this my Will Contained in seven sheets of paper set my hand at the bottom of each of the said preceeding sheets and my hand and seal to this seventh and last Sheet the day and year First within Written Jonn Hemmingway Jonathan married Elizabeth Smithson on 23 Aug 1792 in Dewsbury All Saints.
