Hemingway the younger of Earlsheaton in the parish of Dewsbury and in the County of York, cardmaker, weak in body but of sound and disposing mind and memory, praised be God for the same, do make and ordain this my last will and testament in manner following to wit, whereas I have by my writing of surrender bearing even date herewith surrendered and given up with a straw into the hands of the Lord of the Manor of Wakefield in the said County according to the custom thereof singular my copyhold, messuages, cottages, lands, tenements and hereditaments whatsoever standing lying and being in Earlsheaton aforesaid or elsewhere within the said manor with their and every of their rights, members privileges and appurtenances to the else and behalf of such person and Persons and to and for such intents and purposes as I the said Henry Hemingway should in and by my last will and testament give, devise and bequeath or limit and appoint the same as in and by the said in part recited writing of surrender rotation there to being had will more fully appear now it is my will and mind and I do hereby give devise and bequeath all and singular the said recited to be surrendered tenements hereditaments and premises and also all my freehold messuages, cottages, lands, tenements and hereditaments whatsoever standing, lying and being in Earlsheaton aforesaid or elsewhere within the said County of York with their and every of their rights, members privileges and appurtenances in manner following that is to say First I give and bequeath unto my dear and loving wife ?b?Judith?/b? all that part of the dwelling house or tenement whom I do now inhabit and dwell commonly called the house body and the cellar to hold unto my said wife and her assigns for and during the term of her natural life in her and full satisfaction of all her power and this is which she could or might claim out of my [?] estate and from and immediately after her decease, I give, devise and bequeath the same and every part thereof unto my eldest son ?b?Josiah?/b? Hemingway his heirs and assigns forever also I give and bequeath all the residue and remainder of my said freehold and copyhold messuages, cottages, lands, tenements and hereditaments unto my said wife and her signs for during and until all my children shall have attained their respective ages of twenty-four years and from and immediately after all my children shall have attained their several ages of twenty-four years I give, devise and bequeath the said last mentioned tenements, hereditaments and premises unto my said son Josiah his heirs and assigns forever, he and they paying thereout and also out of all other the tenements, hereditaments and premises devised to him and them as aforesaid. Unto my son and daughters herein after appointed (that is to say) unto my son ?b?Isaac?/b? the legacy or sum of twenty-five pounds of lawful money of Great Britain and unto my two daughters ?b?Phoebe?/b? and ?b?Mary?/b? Hemingway the Legacy or sum of fifteen pounds a piece of like lawful money which said several legacies or sums of money I do hereby give and bequeath and do will and direct the sums and every of them to be paid by my said son ?b?Josiah?/b? Hemingway his heirs or assigns onto my said other son and daughters at the end of one year next after all my said children shall have attained their several ages of twenty-four years. And it is my will and mind that in case any of my said several legatees shall happened to die before they and every one of them shall have attained their several ages of twenty-four years then I do order, direct and appoint that the legacy or legacies of him or her or they so dying shall be equally divided amongst the surviving. Also I give and bequeath unto my said ?b?wife?/b? and her executors, administrators and assigns forever, all my personal estate whatsoever and wheresoever and of what nature, kind or quality so ever the same or any part thereof at mine decease shall or may be, She and they paying thereout all my just debts and funeral expenses.
