    • DEED OF JOSHUA HEMINGWAY FOR LAND IN WOODLESFORD
      REF NO. AQ/405/525 DATED 4TH APRIL 1759

      Indentures of lease and release bearing dates respectively the lease the third and of the release the fifth day of April in the year of the reign of our Sovereign Lord King George II and in the year of Our Lord 1759 made between Joshua Hemingway of Colcotes in the parish of Leeds in the county of York, yeoman of the one part and Richard Butterfield of Woodlesford in the parish of Rothwell in the said county, gentleman of the other part of and concerning all those two closes of arable meadow or pasture ground formerly in one close and now and heretofore commonly called or known by the name of the Toberons situate, lying or being in the township of Woodlesford aforesaid or within the township or territories thereof containing by estimation five acres be the same more or less and now in the tenure or occupation of John Dobson or his assigns lying between the lands heretofore of Richard Wood now of Mr. Garick on the north and the lands heretofore of the Widow Cathill now Joseph Cathill on the south and abutting on the ;land called the Toberons on the west and on the lands heretofore of Henry Clareborough called the Little Ing but now the inheritance of Miss Mognier on the east and all such part and so much of the said Toberans land opposite to the said closes as belong to the same or is reputed part thereof and also the other lands, tenements or hereditaments whatsoever of him the said Joshua Hemingway in Woodlesford aforesaid in whose possession soever now are or be together with all ways, passages, waters, watercourses, hedges, hedgerows, trees, woods, underwoods, commons, common of pasture, easements, mines, quarries, rights, profits, privileges, liberties, easements, commodities, advantages, emoluments, hereditaments and appurtenances whatsoever to the said closes of land and belonging or in any wise appertaining to or with the same or any part now or at any time heretofore used, occupied or on any way enjoyed or accepted reputed, deemed had taken or known as part, parcel or member thereof which said indentures are attested by John Pyemont of Lofthouse in the parish of Rothwell aforesaid, tanner and Samuel Keeling of Temple Newsam in the said county of York, gentleman

      DEED BETWEEN JOSHUA HEMINGWAY OF LEEDS & MARY HEMINGWAY & ELEANOR HEMINGWAY OF LONDON 15TH DECEMBER 1778


      A Memorial of Indentures of lease and release bearing dates respectively the 15th & 16th December 1778 and made or mentioned to be made between Mary Hemingway of King Street, Golden Square in the county of Middlesex, widow and relict of Edward Hemingway late of Boswell Court, near Lincoln Inn Fields in he said county, watchman, deceased of Eleanor Hemingway of Kings Street, Golden Square, aforesaid, spinster the only child and heir of the said Edward Hemingway deceased by the said Mary his wife on the one part and Joshua Hemingway of Leeds in the county of York, saddler of the other part, of and concerning all those three several messuages dwellings, lands or tenements of the description cowhouse garden stead folds land with the well situate therein and also one garth or croft now divided in to two gardens leading from the said foldstead as far as the house wherein one Stephen Jenkinson formerly lived and the said messuages and premises belonging and therewith occupied all the said messuages dwellings tenements shop cowhouse, garth or croft land premises standing lying and being in Beeston in the said county of York and were heretofore in the several possession tenure occupation or use of Samuel Lister & Richard Dawson or their assigns but now or late in the several possession or occupation of William Wilson the younger, Mr Joshua Wills and Thomas Harrison their respective assigns or under tenants and premises were heretofore the estate and debentures of John Atkinson late of West Hall in the said county of York aforesaid Maltster deceased and by him the said John Brown given and devised in and by his last will and testament unto and to the use of Edward & Eleanor Hemingway (and of oath of them situate his heirs and assigns for ever
      And also the messuages, cottages, lands, tenements and hereditaments whatsoever and wherever of the said Mary and Eleanor Hemingway and of oath of them situate in Beeston aforesaid and to which were given and devised by the said John Brown in and by his last will & testament unto the use of the said Edward Hemingway his heirs and assigns as aforesaid together with all the singular the hereditaments rights members privileges and appurtenances which the said indent as to the execution of by the said Mary & Eleanor Hemingway by the said Henry Smith and John ----, Clerks to Joseph Allen at Furnivals Inn, London, Gent and as to the execution by Henry Butterfield of Leeds aforesaid, Gent & Robert Hirst of the same, Clerk

      JOSHUA HEMINGWAY OF LEEDS LAST WILL & TESTAMENT 9th JULY 1793

      This is the last will & testament of Joshua Hemingway of Leeds in the county of York, sadler made this ninth day of January in the year of our Lord, one thousand seven hundred and ninety three, first I give and devise , all and every my messuages , cottages, lands, tenements and hereditaments situate in Beeston in the parish of Leeds aforesaid or elsewhere, unto my wife Elizabeth and her assigns, for and during the term of her natural life, and from and immediately after her decease, I give and devise the same messuages, cottages, lands, tenements & hereditaments unto my Brother Daniel and his assigns, for and during the term of his natural life, and from and immediately after his decease, I give and devise the same premises and every part thereof, unto and amongst, all and every his children lawfully begotten, or to be begotten , their respective heirs and assigns for ever, in such parts, shares and proportions as my said Brother shall by his last will & testament in writing, direct or appoint, and for default of such issue I give and devise the said messauges, cottages, lands, tenements and hereditaments unto my nephew William Goodricke his heirs and assigns for ever, I give and bequeath to my niece Eleanor Judson, the sum of twenty pounds, and to be paid her on attaining the age of twenty one years, by such person or persons who shall or may at that time be in possession of the receipt of the rents and profits of the aforesaid premises, and I do hereby charge the same with the payment thereof accordingly, I also give and bequeath , unto my said wife so much and such part of my household furniture, plate and linen as she shall think proper to take for her own use and benefit (save except the silver pint which she is only to have the use of during her life) , and the residue thereof I give and bequeath unto my said nephew William Goodricke as also said silver pint at the decease of my said wife; and it is my will and mind that the trade and business I now follow be carried on by my said wife to the end of the year, in which I shall happen to dye, in case she think proper to do so, and at the expiration of such year, or her giving up the said business I do hereby devise and direct my Executors hereinafter named to take an inventory and valuation of my stock in trade, working tools and other utensils thereto belonging and that the same stock in trade , working tools and utensils be then delivered to my said nephew William Goodricke so that he may carry on and use and exercise the said trade or business of a sadler, and that he thereupon give a satisfactory security to my said wife, for the due payment of lawful interest to her and her assigns during the term of her natural life, for the amount of the said stock in trade according to the valuation thereof, so to be made as aforesaid, and on the decease of my said wife it is my will and mind that such security to be then cancelled and destroyed and the interest money for the said stock in trade, working tools and utensils cease and be no longer paid; I give and bequeath unto my friends Richard Hargrave of Harewood in the said county of York shopkeeper----and William Westerman of Leeds aforesaid, stuffmaker the sum of two hundred and fifty pounds together with the securities which shall have been taken for the same , and also the legal estate of and in any lands, tenements and hereditaments which now are or hereinafter shall be conveyed to me in mortgage for securing the same or any part thereof their heirs executors administrators and assigns according to the nature thereof UPON TRUST that they , the executors of administrators do and shall in thre first place pay thereout the sum of one hundred and fifty pounds unto my said wife for her own use at the end of six months next after my decease, and also the sum of fifty pounds unto my said nephew William Goodricke at the time of his entering to the aforesaid business, and upon further trust that my said trustees their executors or administrators by and with the approbation of my saisd wife

      put the remaining three hundred and fifty pounds out at interest upon the security upon real estate and pay the produce thereof unto my said wife and her assigns for and during the term of her natural life, and do and also shall at the end of twelve months next after the decease of my said wife pay and divide the three hundred and fifty pounds in manner following (that is to say) to my niece Ruth Rhodes the sum of one hundred and fifty pounds , to my sister Sarah Wilson the sum of eighty pounds, to my sister Mary Judson the sum of ten pounds, to John and Ann the two children of my late sister Ann Dodgson the sum of fifteen pounds apiece, and the sum of eighty pounds unto and amongst the three children of my late sister Eleanor Hargrave in equal proportion share and share alike, and if any of the five children last above mentioned shall happen to dye in the lifetime of my said wife then I will and direct that the legacy of him, her or them so dying shall go and be paid unto and equally amongst the children of him, her or them so happening to dye as aforesaid but in case he, she or they leave no child or children then my will and mind that the same be paid unto the brothers and sisters of him, her or them so dying in the lifetime of my said wife. And as for and concerning all the residue of my estate and effects ( after payment of my debts, funeral expenses and the charges of proving and registering this my last will and testament and raising the said sum of two hundred and fifty pounds for the purpose of discharging the aforesaid legacies) I give and bequeath the same and every part thereof unto the said Richard Hargrave and William Westerman their executors or administrators upon trust to put the same upon real estate and pay the interest to arise therefrom unto my said wife during her natural life , and that at the end of twelve months next after her decease to pay such principal money unto and equally amongst my said sister Sarah Wilson and my two nephews Joshua Hargrave and William Goodricke their executors and administrators share and share alike, and I do declare my will in that case after my just debts, funeral expenses and the said one hundred and fifty pounds to my said wife to be paid, my personal estate shall not be sufficient for payment of the said several other legacies that shall fall short be proportionably abated out of each legacy by the other legatees; And that my said trustees their executors and administrators shall and may reimburse themselves out of the trust monies all such costs ands charges which they or any of them shall expend or to be put unto for or by reason of the trusts hereby in them reposed and shall not be accountable for any more money than shall actually come to their hands respectively, and I do hereby nominate and appoint the said Richard Hargrave and William Westerman joint executors in trust of this my last will hereby revoking all others by me heretofore made and do declare I the said Joshua Hemingway have hereunto set my hand and seal (to wit) my hand at the bottom of the preceding sheet of paper and my hand and seal to this last sheet the day and year first above written
      The Writing contained in this and the other preceding sheet of paper was signed and sealed by the said Joshua Hemingway and by him published and declared as and for his last will and testament in the presence of us who have subscribed our names as witness thereto in his presence and in the presence of each other

      A Declaration instead of an Inventory of all and singular the goods, chattels and credits of Joshua Hemingway late of Leeds in the diocese of York, sadler deceased by Richard Hargrave & William Westerman the executors named in his will

      The said Richard Hargrave and William Westerman hereby declare that the whole of the personal estate and effects of the said deceased would at the time of his death (without deduction) amount to the sum of two thousand pounds
